Terms of Service
These Terms of Service ("Agreement") constitute a legally binding contract between Williamsburg Computer Tech, LLC (operating as D3S, WBCT, and affiliated with cloud.d3s.io, d3s.io, wbcomputertech.com, and logicalgamer.com) ("Provider," "we," "us," or "our") and the individual or entity accessing or using our cloud storage, synchronization protocols, collaborative applications, communication systems, security filters, and artificial intelligence features ("User," "you," or "your").
1. Description of Service & Integrated Apps ↑ Top
Provider supplies private, self-hosted cloud storage, file synchronization, protocol access (including WebDAV, CalDAV, and CardDAV), collaborative document authoring (Nextcloud Office / Collabora Online), rich media asset management (Nextcloud Memories with localized facial recognition), real-time communications (Nextcloud Talk), automated malware defenses (ClamAV daemon), and on-premises AI inference branded as D3S AI (integrated via Nextcloud Assistant and driven by local Ollama runtimes). All infrastructure operates on physical hardware owned, leased, or managed directly by the Provider.
2. Age Eligibility & Minor Accounts (COPPA) ↑ Top
The service is strictly intended for individuals who are at least 13 years of age (or 18 years of age without parental consent). By creating an account, you affirm that you meet this minimum age requirement. We do not knowingly collect personal information, host accounts, or process biometric vector templates for children under 13 without verifiable parental authorization. Accounts identified as belonging to underage minors will be terminated immediately.
3. Storage Quotas, Resource Limits & Overage Policy ↑ Top
Every account is allocated a specific storage quota and bandwidth budget determined by your account tier or administrative grant.
- Quota Enforcement: Once your assigned storage limit is reached, incoming sync actions, uploads, file creation, and document edits will fail or be refused by the server until space is cleared or an upgraded quota is provisioned.
- Automated Trash & Version Purging: Files in your Nextcloud Trash Bin, thumbnail caches, and document version histories may be automatically trimmed, compressed, or purged according to server retention policies to preserve baseline capacity.
- Anti-Abuse & Bandwidth Throttling: Using personal cloud allocations as high-frequency public distribution mirrors, continuous video streaming CDN endpoints, or bot sinks is strictly prohibited and subject to automatic rate-limiting or suspension.
4. Account Security & Two-Factor Authentication (2FA) ↑ Top
You are solely responsible for safeguarding your credentials. We strongly urge all users to activate Two-Factor Authentication (2FA / TOTP) in Nextcloud Security Settings. Provider is not liable for data exfiltration, deletion, or tampering arising from weak passwords, credential stuffing, or compromised client devices.
5. Public Sharing Links & Downloader Conduct ↑ Top
Nextcloud enables you to generate publicly accessible sharing links. You assume full legal liability for all files distributed via links generated under your account.
- Password Protection: We encourage password-protecting and applying expiration dates to public links.
- Prohibited Distribution: Using public links to distribute unlicensed media, malware, copyrighted assets, or prohibited content is strictly forbidden.
- Administrative Revocation: Provider reserves the right to unshare, password-lock, or terminate any public link causing network congestion, copyright claims, or security alerts.
6. Data Portability, Data Migration ("Move Data") & Account Deletion ↑ Top
We respect user data sovereignty and provide built-in tools to manage, export, or permanently remove your stored content:
- Nextcloud Data Export & Migration: You may at any time download your stored files, export your calendar/contact archives via CalDAV/CardDAV or standard WebDAV sync, or utilize Nextcloud's built-in Data Export / Migration ("Move Data") features to package and transfer your account contents to an independent server or local drive.
- E2EE Export Responsibility: If you export or move folders secured with End-to-End Encryption (E2EE), you must ensure you have retained your local client encryption certificates and passphrases; the server-side export package contains encrypted ciphertext that cannot be unlocked without your client keys.
- Account Deletion: You retain the right to delete your account either through the self-service user portal (where enabled) or by submitting a formal deletion request. Upon confirmation of deletion, your account credentials, files, and relational database entries will be immediately detached from active clusters and permanently purged.
7. Dormant & Abandoned Account Policy ↑ Top
Accounts that remain inactive (no successful logins across web, WebDAV, or sync clients) for 180 consecutive days may be flagged as dormant. Notice will be dispatched to your registered email address. If no login is completed within 30 days of notice, Provider reserves the right to archive, compress, or permanently purge account files to recover drive array capacity.
8. Acceptable Use Policy & Prohibited Content ↑ Top
You maintain exclusive legal responsibility for all files, data, sync payloads, office documents, communications, and AI prompts processed through your account. You expressly agree not to use the service to:
- Store, host, transmit, or distribute illegal content under applicable federal, state, or international laws.
- Upload, generate, or transmit Child Sexual Abuse Material (CSAM) or any exploitative content (which triggers immediate, permanent account termination, asset lockdown, and mandatory criminal referral to law enforcement and NCMEC).
- Store or distribute pirated, unlicensed, or copyright-infringing digital assets, media, or software.
- Deploy malicious software, ransomware, bots, trojans, worms, cryptominers, or tools designed to execute automated attacks or scraping.
- Abuse server network capacity, I/O bandwidth, office rendering nodes, or protocol endpoints (e.g., high-frequency WebDAV hammering or brute-force scripts).
- Conduct non-consensual biometric processing or unlawful visual surveillance through Nextcloud Memories.
- Utilize Nextcloud Talk for harassment, non-consensual eavesdropping/recording, or unauthorized robocalls.
- Utilize D3S AI to craft malware, generate phishing or social engineering campaigns, facilitate cyberattacks, or produce harassing, threatening, or defamatory material.
9. DMCA Copyright Takedown Procedure ↑ Top
We respect intellectual property rights and comply with the statutory safe-harbor provisions of the Digital Millennium Copyright Act (17 U.S.C. § 512). If you believe material hosted on our servers infringes your copyright, submit a written notice to our designated agent containing:
- Identification of the copyrighted work claimed to be infringed.
- Identification of the specific URL, sharing link, or file path to be removed or disabled.
- Your contact information (name, mailing address, telephone number, and email).
- A statement of good-faith belief that use of the material is unauthorized.
- A statement under penalty of perjury that the information provided is accurate and that you are authorized to act on behalf of the copyright owner.

10. Automated Malware & Antivirus Scanning (ClamAV) ↑ Top
To defend server health and shield users from malicious transmissions, Provider employs automated background antivirus and trojan scanning powered by a local ClamAV daemon.
- Right to Block & Quarantine: Any unencrypted file upload or synchronized asset containing signatures matching known viruses, trojans, ransomware, or malicious scripts will be refused or quarantined immediately without notice. Provider accepts no liability for quarantined or purged payloads.
- No Clean-System Guarantee: Automated scanning represents a best-effort defensive barrier; signature databases cannot guarantee detection of zero-day exploits or novel polymorphic threats. You remain solely responsible for endpoint antivirus protection on your devices.
- False Positives: Heuristic filters may occasionally flag benign custom binaries, game modifications, or scripts. Users may contact support to request review of quarantined files.
- E2EE Exemption: Files placed in client-side End-to-End Encrypted (E2EE) folders cannot be parsed or evaluated by ClamAV because data is encrypted prior to arrival on the host filesystem.
11. Nextcloud Office (Collabora Online) Terms ↑ Top
Nextcloud Office allows real-time collaborative editing of text documents, spreadsheets, and presentations powered by a self-hosted Collabora Online instance.
- Document State & Concurrency: Collaborative editing loads temporary document state into active server memory. The Provider is not responsible for uncommitted revisions lost due to client disconnects, session timeouts, or unexpected browser termination.
- File Integrity: While Collabora provides high compatibility with OpenDocument and Microsoft Office formats, layout discrepancies or macro incompatibilities may occur. You are responsible for preserving original backups of critical formatted files.
12. Nextcloud Memories & Local Facial Recognition ↑ Top
Nextcloud Memories provides high-performance gallery browsing and client/server-assisted media clustering.
- Localized Processing: Facial detection and visual recognition models run 100% locally on the Provider's private server hardware. No photographic assets or biometric vectors are transmitted to outside corporations.
- User Authorization: You represent and warrant that you possess all legal permissions and consents required from individuals whose likenesses appear in photos processed by recognition models in your account.
- Algorithmic Fallibility: Visual categorization is heuristic and automated; the Provider offers no guarantee of facial recognition clustering accuracy.
13. Nextcloud Talk (Real-Time Communication & Calls) ↑ Top
Nextcloud Talk provides text chat, audio calls, video conferences, and screen sharing across WebRTC standards.
- No Emergency Services: Nextcloud Talk is not a telecommunications replacement and cannot be used to contact emergency services (such as 911).
- Recording & Participant Consent: If you record a meeting or communication session, you are solely responsible for complying with all applicable wiretapping and audio recording consent laws (including all-party consent jurisdictions).
- Session Quality: Media quality depends on client bandwidth and peer-to-peer network routing. The Provider provides no quality-of-service (QoS) guarantees for real-time video or audio streams.
14. Federated Cloud Sharing (Nextcloud Federation) ↑ Top
When you connect with remote Nextcloud instances via Federated Cloud ID (sharing folders or Talk rooms with external servers), files and messages routed to that remote server leave our administrative perimeter and become subject to the independent security, retention, and privacy policies of that remote host.
15. D3S AI (Nextcloud Assistant & Self-Hosted Ollama Backend) ↑ Top
D3S AI delivers localized Large Language Model (LLM) processing directly on our private infrastructure through Ollama. All AI queries remain on-premises and are never forwarded to commercial third-party APIs (such as OpenAI, Anthropic, or Microsoft).
- Model Availability & Selection: Available models (e.g., Llama, Mistral, Qwen, Phi, or custom open weights) are managed at the sole discretion of the Provider. We reserve the right to deploy, modify, substitute, or retire specific models at any time based on hardware constraints or maintenance needs.
- No Guarantee of Accuracy: Generative AI models operate probabilistically and may produce inaccurate, biased, outdated, or fabricated information ("hallucinations"). You are solely responsible for independently verifying all AI outputs.
- No Professional Reliance: D3S AI outputs do not constitute licensed legal, medical, financial, tax, or engineering advice. The Provider disclaims any liability arising from actions taken based on AI responses.
- Fair Use & Resource Management: AI inference consumes shared compute resources. The Provider reserves the right to rate-limit, throttle, or queue heavy AI workloads to protect server stability.
16. End-to-End Encryption (E2EE) & Private Key Responsibility ↑ Top
Our Nextcloud platform supports client-side End-to-End Encryption (E2EE) for folders and documents.
Files placed inside E2EE-enabled folders are encrypted on your client hardware before network transmission. The Provider does not possess, manage, or store your encryption passphrases or recovery keys. THE PROVIDER CANNOT RESET OR RECOVER LOST E2EE KEYS. If you lose or misplace your passphrase or recovery string, your files become permanently and cryptographically unreadable. The Provider accepts zero liability for permanent data loss resulting from lost passphrases.
Note: Nextcloud Office, ClamAV, Nextcloud Memories face recognition, and D3S AI cannot view, index, or parse documents stored inside E2EE-encrypted folders because server-side decryption is mathematically impossible without your client key.
17. Reverse Engineering, Security Probing & Bug Bounty ↑ Top
We take system stability and infrastructure security seriously. To prevent service disruption to other users, strict rules apply to security testing and reverse engineering:
- Prohibited Attacks: You may not decompile, reverse engineer backend orchestration code, execute destructive exploit payloads, launch Denial of Service (DoS/DDoS) attacks, flood protocol endpoints, or attempt physical or social engineering attacks against our administrators or hosting hardware.
- Authorized Vulnerability Reporting: If you discover a potential vulnerability, sync exploit, privilege escalation, or data leak within our Nextcloud/Collabora/Talk/Ollama deployment, you agree to report it immediately and confidentially via our designated security reporting channel: .
- Bug Bounty Policy: We operate a discretionary, good-faith bug bounty program. Valid, novel, and responsibly reported vulnerabilities disclosed without public leaks or data compromise may be eligible for recognition or discretionary rewards at Provider's sole discretion. Unauthorized public disclosure without allowing reasonable remediation voids all bounty eligibility and may result in account termination and legal action.
18. Scheduled Maintenance, Outages & No-SLA Disclaimer ↑ Top
The service is hosted on privately operated infrastructure. We do not provide an enterprise Service Level Agreement (SLA) guaranteeing 99.9% uptime. Routine maintenance, operating system patching, storage rebalancing, hardware upgrades, and ISP network interruptions will occur periodically with or without prior notification.
The service is provided strictly on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind.
19. Limitation of Liability ↑ Top
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WILLIAMSBURG COMPUTER TECH, LLC, D3S, WBCT, WBCOMPUTERTECH.COM, OR LOGICALGAMER.COM, NOR THEIR OFFICERS, MEMBERS, AGENTS, OR OPERATORS, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. THIS INCLUDES, WITHOUT LIMITATION, DAMAGES FOR LOSS OF DATA, SYSTEM DOWNTIME, CORRUPTED STORAGE, LOST PROFITS, REPUTATIONAL HARM, OR BUSINESS INTERRUPTION, REGARDLESS OF LEGAL THEORY.
You expressly agree that you are solely responsible for keeping independent, secondary, offline backups of all critical personal or organizational files.
20. Governing Law & Dispute Resolution ↑ Top
This Agreement shall be governed by, interpreted, and construed in accordance with the substantive laws of the Commonwealth of Virginia, United States of America, without regard to its conflicts of law principles. Any legal action or proceeding arising out of this Agreement shall be brought exclusively in the state or federal courts with jurisdiction over Williamsburg / James City County, Virginia.
